A Memorial of an Indenture made the Sixth day of May one thousand eight hundred and forty eight Between John Lovell, Printer, John Gibson, Printer, and Sarah Gibson, otherwise Sarah Lovell his wife, William Lovell, Grocer, John Wiseman, Cabinet Maker, and Jane Wiseman, otherwise Jane Lovell his wife, William Chisholm Fletcher Caverhill, Merchant, and Mary Caverhill, otherwise Mary Lovell his wife, James Lovell, Printer, William Meikle, Merchant, and Theodarah Meikle, otherwise Theodorah Lovell his wife, All of the City of Montreal except the said William Chisholm Fletcher Caverhill and Mary his wife of Coleau de Lac, and the said William Meikle and Theodorah his wife, who are of Lachute in the Province of Canada in North America, of the one part and Thomas Clear, of Bandon in the County of Cork Ireland, Gentleman, of the other part, reciting that by Indenture of Settlement of the fifth day of March one thousand eight hundred and eight made between John Lovell of Knockbrogan in said County, Gentleman, of the first part Robert Lovell of Knockbrogan in said County, Gentleman, and Jane Lovell otherwise Beazley his wife, of the second part, William Beazley of the third part, and John Bull and John Roberts of the fourth part, the said John Lovell in consideration of three hundred pounds to him paid or secured by said William Beazley and of ten shillings paid him by the said John Bull and John Roberts as signed and made over unto the said John Bull and John Roberts, their exors admors and assigns, one undivided moiety of two lots part of the Lands of Knockbrogan and all his estate and interest of Renewal therein To hold same for the residue of the term of twenty years and for such terms as should be obtained of same upon trust to permit said Robert Lovell and his assigns during his life to receive the rents thereof and after his decease to the use of such child or children or so many or such of the children of said Robert and Jane in such shares and manner as the said Robert Lovell should by Deed or will attested by two or more credible subscribing witnesses direct limit and appoint and reciting by Deed of Appointment dated the fifth day of May one thousand eight hundred and forty eight after reciting that there were then living issue of the Marriage of the said Robert Lovell and Jane the said John Lovell, Sarah Gibson, William Lovell, Jane Wiseman, Mary Caverhill, James Lovell, and Theodorah Meikle who had all attained their age of twenty one years and no other issue and that the said Robert Lovell was desirous and had determined to appoint the said moiety amongst said children as hereinafter mentioned charged and chargeable with the payment of the sum of one hundred and fifty one pounds being the sum payable thereout and chargeable thereon in respect of the purchase of the perpetuity of the said Moiety of said Lands ) the said Robert Lovell in pursuance of the power given by said recited Indenture of the fifth of March one thousand eight hundred and eight Did irrevocably direct and appoint that immediately after the execution thereof subject to the estate for life of him the said Robert Lovell therein and charged and chargeable with the payment of the sum of one hundred and fifty one pounds ) one undivided moiety share and proportion of said two lots should belong and be to the use of said John Lovell, Sarah Gibson, William Lovell, Jane Wiseman, Mary Caverhill, James Lovell, and Theodorah Meikle in equal shares as tenants in common and to their respective heirs and assigns and after further reciting as therein said Deed whereof this is the Memorial Witnessed that the said John Lovell, John Gibson, and Sarah his wife, William Lovell, and Jane his wife, William Chisholm Fletcher Caverhill, and Mary his Wife, James Lovell, and William Meikle, and Theodorah Meikle his Wife in consideration of the sum of Five hundred pounds Sterling to them in hand well and truly paid by the said Thomas Clear granted bargained assigned released and confirmed unto the said Thomas Clear All that one undivided moiety half part share and proportion of and in All that and those two lots part of the Lands of Knockbrogan situate in the Barony of Kinalmeaky and County of Cork the first or East lot containing by William Sullivan's Survey Fifty seven acres three rods and seventeen perches and the second lot containing by said Survey twenty one acres and thirty one perches more or less with the rights members and appurtenances and the reversions remainders yearly and other issues and profits thereof and all their estate and interest in said two lots of said Lands of Knockbrogan, To hold same to the said

Witnesses to the execution of said Deed and this Memorial by John Lovell, John Gibson, Sarah Gibson, William Lovell, John Wiseman, Jane Wiseman, William Chisholon Fletcher Caverhill, Mary Caverhill, James Lovell, William Meikle, and Theodorah Meikle, are Joseph Rogers of the City of Montreal, Gentleman, and Alexander Burtara of the same place Advocate and which said Deed and this Memorial as to the execution thereof by the said Thomas Clear are respectively duly witnessed by William Carey and Richard Topham both of Bandon in the County of Cork writing Clerks
